Effective date: October 20, 2026 | Last updated: October 20, 2026
Cloud 9 Kitchen & Market ("Cloud 9," "we," "us," or "our") operates cloud9kitchen.net (the "Site") and our restaurant, market, and fuel location at 123 State Route 17, Hasbrouck Heights, New Jersey 07604. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit the Site, create a Cloud 9 Rewards account, place an order, enter a promotion or sweepstakes, contact us, or order from us through a third-party delivery marketplace such as Uber Eats.
By using the Site or our services, you acknowledge the practices described in this Privacy Policy. If you do not agree, please do not use the Site.
1. Information We Collect
Information you provide to us. Depending on how you interact with us, we may collect:
- Account and contact information: name, email address, mobile or other phone number, login credentials, and account preferences.
- Order and fulfillment information: items ordered, customizations and special instructions, pickup or delivery address, delivery instructions, table or fuel-pump QR code information, and order history.
- Rewards, coupons, and promotions: membership details, points, coupon and voucher activity, sweepstakes entries, and information needed to confirm eligibility (such as age or residency).
- Communications: emails, text messages, reviews, survey responses, RSVPs, and customer-support requests.
- Payment information: when you pay by card, payment is processed by our payment providers (currently Stripe for online payments, when available, and Helcim for in-store card payments). We receive limited transaction details such as the amount, date, status, and payment method type. We do not store full payment card numbers on the Site.
Information collected automatically. When you use the Site, we and our service providers may automatically collect device and usage information, including IP address, browser type and version, operating system, device identifiers, referring and exit pages, pages viewed, timestamps, session and cart information, and server logs. We use this information to operate the Site, maintain security, and understand how the Site is used.
Information from third parties. We may receive information from delivery marketplaces (such as Uber Eats), payment processors, email and SMS providers, hosting and security providers, and other service providers that help us operate our business. For example, when you place an order through Uber Eats, Uber Eats sends us the order details needed to prepare and fulfill your order.
2. How We Use Information
We use personal information to:
- accept, prepare, and fulfill orders, including pickup, curbside, dine-in, and delivery orders;
- process payments, issue refunds, and maintain transaction records;
- create and manage accounts, Cloud 9 Rewards membership, points, coupons, and promotions;
- administer sweepstakes and verify eligibility;
- communicate with you about orders, accounts, promotions, and customer service;
- send marketing communications where permitted by law and subject to your choices;
- personalize and improve the Site, menu, and customer experience;
- detect, prevent, and address fraud, abuse, security incidents, and technical problems;
- comply with legal, tax, accounting, and regulatory obligations and enforce our agreements; and
- evaluate or complete a business transaction, such as a merger, acquisition, or sale of assets.
Where applicable law requires a legal basis, we rely on performance of a contract (to provide your order or account), our legitimate interests (to operate, secure, and improve our business), your consent (for certain marketing or optional features), and compliance with legal obligations.
3. Cookies and Similar Technologies
We use cookies and similar technologies that are necessary to operate the Site, including to maintain your session, keep items in your cart, remember preferences, and protect against fraud and abuse. Our infrastructure and security providers (such as Cloudflare) may also set security and performance cookies. The Site loads fonts from Google Fonts, which may receive your IP address when your browser requests those files.
We do not currently use third-party advertising cookies or cross-site behavioral tracking pixels on the Site. If we add these technologies in the future, we will update this Privacy Policy and, where required, provide appropriate choices.
You can control cookies through your browser settings. Disabling cookies may affect your ability to use the cart, sign in, or complete an order. Where required by applicable law, we honor Global Privacy Control (GPC) signals as a request to opt out of sale or sharing. Because we do not sell personal information or share it for cross-context behavioral advertising, there is currently no such sale or sharing to opt out of.
4. How We Share Information
We do not sell or rent personal information. We may share personal information in the following circumstances:
- Service providers. We share information with vendors that perform services for us, such as hosting and infrastructure, payment processing, email and SMS delivery, security, analytics, and information technology support. These providers are authorized to use the information only to provide services to us and are subject to contractual obligations.
- Delivery marketplaces. When you order through Uber Eats or another delivery marketplace, or when you choose a delivery service through us, we share or receive the information needed to prepare, deliver, and support your order, such as order details, order status, menu and item availability, and store availability.
- Legal and safety. We may disclose information if required by law, legal process, or a governmental request, or if we believe disclosure is necessary to protect the rights, property, or safety of Cloud 9, our customers, or others.
- Business transactions. We may transfer information as part of a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, subject to appropriate confidentiality protections.
- With your direction or consent. We may share information when you ask us to or when you consent.
5. Uber Eats and Other Delivery Marketplaces
We use application programming interfaces ("APIs") provided by Uber Eats and other delivery marketplaces to receive and manage marketplace orders, send order status, and synchronize menu items and store availability. Information we receive through those APIs is used only to provide the services you request and as described in this Privacy Policy.
When you place an order through Uber Eats, Uber Eats collects and controls your information under its own privacy policy. The order information we receive may include your name or initials, delivery address, order items and special instructions, a masked or relay phone number, and order status. We use this information to prepare and fulfill your order, provide customer support, keep accounting records, and comply with legal obligations. We do not receive your full payment card number from Uber Eats.
We encourage you to review the privacy policy of Uber Eats or any other marketplace you use. Their privacy practices are not controlled by Cloud 9.
6. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy. This may include retaining information while your account is active, to complete orders and honor promotions, to maintain tax and accounting records, to resolve disputes, to enforce our agreements, and to comply with legal obligations. When information is no longer needed, we delete, de-identify, or aggregate it. Retention periods vary depending on the type of information and our legal requirements.
7. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit (HTTPS/TLS), access controls, and contractual safeguards with service providers. However, no method of transmission or storage is completely secure. Please protect your account credentials and contact us promptly if you believe your information has been compromised.
8. Children's Privacy
The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. Cloud 9 Rewards membership and sweepstakes are intended for individuals who are 18 or older (or the age of majority in their jurisdiction). If you believe a child has provided us with personal information, please contact us and we will delete it.
9. Your Privacy Rights and Choices
Depending on where you live and whether our processing is covered by applicable law, you may have the right to:
- know or access the personal information we hold about you;
- correct inaccurate personal information;
- delete personal information, subject to legal exceptions;

- opt out of the sale or sharing of personal information or its use for targeted advertising;

Other states may provide similar rights. To submit a request, email [email protected] with the subject line "Privacy Request," or write to us at the address below. Marketing choices. You can unsubscribe from marketing emails using the unsubscribe link in the email or by contacting us. You can opt out of marketing texts by replying STOP. We may still send transactional messages about your orders or account. Even if you opt out of marketing, we may retain information as required for recordkeeping and legal compliance.
10. Third-Party Sites and Services
The Site may link to or integrate with third-party services, including Uber Eats, Google Maps, and payment processors. Those services have their own privacy policies and practices. We are not responsible for the privacy practices of third parties, and we encourage you to review their policies before providing personal information.

If you access the Site from outside the United States, your information may be transferred to, stored in, and processed in the United States, where privacy and data-protection laws may differ from those in your country. 12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will post the revised policy on this page and update the effective date above. If we make material changes, we may provide additional notice, such as by email or a notice on the Site.
